POETIK YOGA, SARL, with a share capital of 2,000 euros, whose registered office is located at 6 rue du Plat, 59000 Lille, registered with the Lille Trade and Companies Register, under number 88205531200012, has as its object the exemption from of traditional Hatha Yoga with personalized course concepts.
 
Yoga is a method of physical and mental conditioning. This activity mainly combines postures, breathing and relaxation.
 
 
Article 1: object
 
These General Conditions of Sale, hereinafter referred to as GCS, constitute the contract (hereinafter "Contract") which governs the contractual relationship between POETIK YOGA and the customer (hereinafter "Customer") and are applicable to all sales. of services (hereinafter "Services") provided to individuals and/or consumers, by POETIK YOGA to the exclusion of any other contractual document.

 
Article 2 - Services offered
 
Three types of services are offered to Customers.
 
1/ Group Yoga classes:
 
This service consists of access, within the limits of opening hours, to group Yoga lessons, supervised by a certified Yoga teacher holding a recognized Alliance International diploma, subject to having reserved his session in advance on the form available on the website or via exchange of emails.
 
2/ Private Yoga class:
 
This service consists of offering a particular yoga class following an exchange between POETIK YOGA and the client. The service can be set up outside the opening hours of the studio.
 
 
3/ Workshops and conferences:
 
This service consists for the Customer to participate in a workshop or a conference led by POETIK YOGA and/or an external speaker in different fields or activities related to Yoga and related themes. Each presentation and/or advice will be provided by the authorized expert. 
 
The yoga mats are made available to carry out the said service, subject to the Customer having reserved his session in advance on the website.

Article 3 - Terms of subscription to the Services
 
POETIK YOGA offers several types of formulas:
 

• Session lessons  

• Notebook of five (5) sessions

• Book of ten (10) sessions

• Quarterly subscription 1 lesson per week

• Quarterly subscription 2 lessons per week

• Workshop  

• Conferences  

• Retreats in France or abroad

• Online courses and training  

 
To subscribe to the services offered by POETIK YOGA, the Customer can come spontaneously during the opening hours of the studio, located 6/8 rue du plat in Lille (59 000)
 
 
Article 4 - Validation of your order 
 
The Client declares to have read the T&Cs and to adhere to them without reservation except in the case of Retreats in France or abroad. 
In the latter case, the order will be validated, after the Customer has accepted and signed these T&Cs on the site outside the book form and at the session.

 
Article 5 - Payment
 
The subscription implies for the Customer the obligation to pay the indicated price. 
 
The Customer will pay the advertised price All Taxes Included (TTC) according to the chosen formula defined below:
 

• Session lessons  : 17 euros including tax on the day of subscription;

• Discovery card for three (3) sessions: 27 euros including tax on the day of subscription;

• Book of five (5) sessions: 80 euros including tax on the day of subscription;

• Book of ten (10) sessions: 155 euros including tax on the day of subscription;

• Quarterly subscription 1 lesson per week: 180 euros including tax on the day of subscription;

• Quarterly subscription 2 lessons per week  : 290  euros including tax on the day of subscription;

• Parent-child class: 17  euros including tax on the day of subscription;

• Book of ten (10) parent-child sessions: 150 euros including tax on the day of subscription;

• Prenatal course: 25  euros including tax on the day of subscription;

• Book of ten (10) prenatal  : 190 euros including tax on the day of subscription;

• Gift card:  free amount from 27 €

• Outdoor session lessons  : 17 euros including tax on the day of subscription;

• Workshop :  variable amount

 
The payment by the Customer of the price of the Services offered by POETIK YOGA implies the Customer's unreserved acceptance of these GCS and the rules of procedure displayed in the room at 6 rue du Plat (59 000 Lille).
 
If the Customer is not up to date with his payment, he will be refused access to the room until regularization.
 
Article 6 - Duration of validity of subscriptions and session
 
The purchased session is valid the same day of subscription.
 
The book of five (5) and ten (10) sessions is valid for three (3) months from the date of the first lesson, which must be taken within 3 months of the date of purchase.
 
Quarterly subscriptions are valid for three (3) months from the date of the first lesson, which must be taken within 3 months of the date of purchase.

 
Article 7 - Termination / Suspension
 
 
7.1 At the Customer's initiative
 
Sessions and notebooks of five (5) or ten (10) sessions are neither cancellable nor refundable, nor transferable to a third party. 
 
However, in case of force majeure (closure of the studio for natural disaster for example):

• Cards and subscriptions will be suspended for the duration of the closure;

• The cards and subscriptions will be transferable to a third party in the event of inability to resume during the reopening.   ;

 
7.2 At the initiative of POETIK YOGA
POETIK YOGA may terminate the Contract in the following cases, namely, in the event of non-compliance with the internal regulations, fraud in the constitution of the registration file, payment incident, it being specified that a first payment incident gives rise to the suspension of the Contract until its regularization.
 
 
Article 8 – Rules of procedure

The Customer declares to have read, beforehand, the rules of procedure displayed in the premises of POETIK YOGA and available on the website  adhere to it without restriction or reservation before any subscription. 
In the event of non-compliance with the rules of procedure, and after formal notice to confirm it has remained in vain, POETIK YOGA reserves the right to immediately terminate the Contract without having to pay compensation or indemnities to the Client.
 
 
Article 9 - Liability

POETIK YOGA is insured for damage engaging its Professional Civil Liability. The responsibility of POETIK YOGA cannot be sought in the event of an accident resulting from the non-observance of the rules of procedure, the safety instructions or the inappropriate use of the equipment or other installations. 
The Customer is invited to take out a Personal Civil Liability insurance policy covering him for any damage he may cause to third parties on his own account during the exercise of the activities offered by POETIK YOGA.
In addition, the Client declares, when subscribing to any service with POETIK YOGA, to have had his/her ability to practice a sporting activity checked beforehand by a doctor and to hold a certificate of non-contraindication to the practice of an activity. athletic. 
In the absence of such a certificate, the Customer releases POETIK YOGA from any responsibility for the problems he may encounter during the practice of the proposed activities. 

 
Article 10 - Intellectual property
All elements of the POETIK YOGA website are and remain the exclusive intellectual property of the company. No one is authorized to reproduce, exploit, redistribute, or use for any reason whatsoever, even partially, elements of the site whether software, visual or sound.
Any simple or hypertext link is strictly prohibited without the express written consent of POETIK YOGA
 

Article 11 - Personal data & image rights

The information collected during the subscription of the contract is subject to automatic processing by POETIK YOGA.
In the event of signing a contract with POETIK YOGA, the customer expressly accepts that all information and personal data will be transferred to POETIK YOGA for the sole purpose of being able to perform the service.
The information strictly necessary for the performance of the service may be communicated to external parties of POETIK YOGA as part of the performance of the said service.
This information cannot be used for other purposes.
The information collected will only be kept by POETIK YOGA for a period not exceeding the period necessary for the performance of the service.
The information collected will be kept only in Europe.
In accordance with the Data-processing law and Freedom n°78-17 of January 6, 1978, modified in 2004, the customer has a right of access, rectification, opposition, suppression of the personal data concerning him. This right is exercised by writing directly to POETIK YOGA by the email address at: poetik.yoga@gmail.com, attaching a copy of their identity document.
Furthermore, and in accordance with the provisions of Article L223-2 of the Consumer Code, the Customer has the right to register on the list of opposition to canvassing, known as BLOCTEL.
This registration is free and can be done.
During the sessions, no photos or videos where the client is recognizable  can be made for commercial purposes. 
If the client does not wish to appear in the photos and/or videos, he is required to inform the management before the start of the session. In this case, it is assured that it will not appear on the images.
Photos/videos can be published on the website  and on related Facebook, Instagram and Twitter accounts.
POETIK YOGA reserves the right to store users' personal data (photos included) and to use, process and transmit them, if this is necessary and/or useful for the contractual relationship.
POETIK YOGA undertakes not to transfer the photos/videos referred to to third parties without the written authorization of the Client.
 
 
Article 13 – Mediation

In the event of a dispute, article L.152-1 of the Consumer Code provides for the possibility of having recourse to the consumer mediator
 
 
Article 14 – Withdrawal period

It is recalled that, in accordance with the provisions of articles L221-18 and following of the Consumer Code:

- the Customer has the right to withdraw from the contract signed with POETIK YOGA in the context of distance sales, without giving any reason, within fourteen days;
- the fourteen-day withdrawal period begins to run from the day of the conclusion of the contract, it being specified that the day on which the contract is concluded is not counted within the time limit of 14 days;
- the withdrawal period begins to run at the beginning of the first hour of the first day and ends on the expiry of the last hour of the last day of the period;
- if the withdrawal period normally expires on a Saturday, Sunday or a public holiday or non-working day, it is extended until the first following working day;
- to exercise the right of withdrawal, the Customer must notify POETIK YOGA of his decision to withdraw from the contract by means of an unambiguous declaration using the withdrawal form annexed to these GTC (Appendix n ° 2) and to be sent, as desired, by email to the address poetik.yoga@gmail.com or by registered mail with acknowledgment of receipt at 6/8 rue du plat, LILLE  (59,000) or hand delivered to the studio.
- for the withdrawal period to be respected, the Customer must imperatively communicate his request before the expiry of the period of fourteen (14) days.
In the event of withdrawal, POETIK YOGA will reimburse all payments received, without undue delay and, in any event, no later than fourteen days from the day on which it is informed of the decision to withdraw from this contract; this reimbursement will not incur any costs for the Customer, with the exception of the costs of sending the notification of withdrawal.
In accordance with the provisions of article L221.25 of the Consumer Code, the Customer has the possibility of requesting that the provision of the service begin before the end of the aforementioned withdrawal period in the context of distance selling. This request must be express.
 
If the Customer exercises his right of withdrawal while the performance of the service, at his express request, has begun before the end of the withdrawal period, the Customer is required to pay an amount proportional to the service provided until receipt of the withdrawal request.
 
 
Article 15 - Applicable law in the event of disputes 
All disputes or disagreements related to the interpretation or execution of these general conditions of sale will be submitted to the competent courts under the conditions of common law.
These general conditions of sale are written in French. In the event that they are translated into one or more foreign languages, only the French text shall prevail in the event of a dispute.
 
 
Article L215-3 of the Consumer Code
The provisions of this chapter are also applicable to contracts concluded between professionals and non-professionals.
